Terms of Service

Welcome to MyNextService. These Terms of Service ("Terms") govern your use of the My Next Service mobile application and web platform (the "Service") operated by MyNextService ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

MyNextService is a field service management platform that provides:

• Job scheduling and management
• Customer relationship management
• Route optimization and GPS tracking
• Invoicing and payment processing
• Team coordination and communication
• Business analytics and reporting
• Integration with third-party services (QuickBooks, Square, etc.)

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the authority to bind your organization to these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Transmit malware or other harmful code
• Use the Service to send spam or unsolicited communications

5. Third-Party Integrations

The Service integrates with third-party services including but not limited to QuickBooks, Square, Stripe, Twilio, and SendGrid. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of third-party services.

QuickBooks Integration: When you connect your QuickBooks account, you authorize MyNextService to access your financial data for the purpose of syncing P&L reports and calculating business valuation metrics. You can disconnect this integration at any time.

6. Data Ownership

6.1 Your Data

You retain all ownership rights to the data you input into the Service, including customer information, job records, and business data. We do not claim ownership of your data.

6.2 License to Use

You grant us a limited license to use, process, and store your data solely for the purpose of providing and improving the Service.

6.3 Data Portability

You may download a complete export of all your data at any time through the Service's data export feature. Exports are provided in CSV and JSON formats with a documented schema manifest describing every field. We do not charge for data exports.

6.4 Nightly Data Backup

We maintain nightly encrypted backups of your data to independent cloud storage. You may access your backup history and download prior exports (up to 30 days) through the Service dashboard. You receive independent access credentials to your backup storage, enabling direct access without our involvement.

7. Payment Terms

Subscription fees are billed in accordance with your selected plan. All fees are non-refundable unless otherwise specified. We reserve the right to change pricing with 30 days notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

10. Indemnification

You agree to indemnify and hold harmless MyNextService and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service will immediately cease.

12. Service Continuity

If we cease operations or fail to maintain the Service for more than fourteen (14) consecutive days, we shall:

• Deliver a final full export of all your data in the documented format within seven (7) days of cessation
• Maintain your backup storage access through the end of your current billing period
• Provide reasonable assistance to migrate your data to a successor platform of your choosing

These obligations survive termination of this Agreement.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and sending an email notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
